Terms of use

These terms are also available in German. For customers in Germany, Austria and Switzerland, the German version prevails if the two differ.

These terms apply to the Baku app and the website baku.care. Baku is a calm companion for the night: a wellness app that helps you work with bad dreams and get through 3 a.m. It is not a medical service. The short version: your entries are yours, Nightlight stays free, Plus is billed by Apple or Google and you can cancel at any time, and the law of your country still protects you.

1. Who we are and what these terms cover

Baku is a product of BSNS GmbH and is provided by BSNS GmbH, a limited liability company under Swiss law, Birkenstrasse 47, 6343 Rotkreuz, Switzerland, UID CHE-213.120.212 ("Baku", "we"). These terms apply when you use the app, the website, gifts and our emails. By creating an account or using Baku you agree to them. The privacy policy explains how we handle your data, and the medical disclaimer is part of these terms. Buying a gift is also covered by the gift terms; creators and partner practices have their own creator terms and partner terms.

2. What Baku is, and what it is not

Baku helps you work with bad dreams using methods research supports, such as imagery rehearsal, and helps you through the night. Baku is not a medical device and not a medical service. It does not diagnose, treat, cure or prevent any disease, and it does not replace a doctor, psychologist or therapist. Content in the app and on the website is general information, not advice for your situation.

Baku is not a crisis service and is not monitored around the clock. If you are in danger or thinking about harming yourself, call your local emergency number or a crisis line now. The app shows local help lines.

3. Who can use Baku, and your account

You must be at least 16 years old in Switzerland, the European Union and the United Kingdom, and at least 13 elsewhere (or older where local law requires it). Many features work without an account. If you create one, keep your sign-in safe and tell us if you think someone else is using your account. One account is for one person.

4. Free and Plus

Some features are free, including Nightlight, the 3 a.m. mode, which stays free. Others need a paid subscription, Baku Plus. The features and prices are shown in the app and on the pricing page before you buy.

  • Where you buy: subscriptions are bought and billed through the Apple App Store or Google Play under their terms; the contract for the payment is with them.
  • Trial: a free trial, if offered, turns into a paid subscription at its end unless you cancel before. We remind you before a trial ends.
  • Renewal: subscriptions renew automatically for the same period until you cancel in your App Store or Google Play account settings, at the latest 24 hours before the end of the period. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for.
  • Price changes: we tell you in advance; a new price applies from your next renewal and you can cancel before it takes effect. Where the store requires your agreement to a higher price, we ask for it.
  • Refunds and withdrawal: refunds are handled by Apple or Google under their policies. If you live in the EU or the UK you have a statutory right to withdraw from a purchase within 14 days; for digital content that starts straight away, the right ends when the content is provided with your consent, as the store explains at checkout. Your statutory rights as a consumer are not affected.
  • Free months and codes: free months from an invitation, a gift or from us are promotional periods. They end by themselves, do not renew and cannot be exchanged for money. A creator, practice or studio code gives a longer free trial instead (two weeks), which works like any trial above. One welcome code per account; codes may not be sold or used commercially. If a code is abused we may withdraw what it unlocked.

5. Gifts

You can give Baku Plus to someone else on the website or in the app. The gift terms set out how gifts are bought, delivered, opened, started, passed on and refunded. In short: the recipient opens the gift card from a link, and the months of Plus begin only when they start the gift in the app; a gift never renews, and it can be started until 31 December of the third year after it was bought.

6. Your content

Everything you write or record in Baku stays yours. You give us only the rights we need to store, sync and process it to provide Baku to you, for example to transcribe a voice note or, when you ask, to have the Guide reflect on an entry. We do not use your content for advertising and do not sell it. You can export your data and delete your account at any time in the app; deletion becomes permanent after a 30-day grace period, as the privacy policy describes.

Things you share outside Baku (for example a share card on social media) are your choice; please share only what you are comfortable with others seeing.

7. The AI Guide

The Guide uses artificial intelligence, and the app tells you when you are talking to it. Its answers are suggestions, can be wrong, and are not medical, psychological or other professional advice. You decide what to do with them; nothing in the app changes until you confirm it. Do not rely on the Guide in an emergency. You can switch AI features off.

8. Partner mode

If you invite a partner, you decide what they can see, and you can change that or end the connection at any time. Partners never see dream content unless you share it. If you join as a partner, send only messages that are kind and that the other person has asked for.

9. Sleep data from devices

If you connect Apple Health, Health Connect, WHOOP or Oura, Baku reads your sleep as described in the privacy policy. Figures from consumer devices are estimates, not medical measurements. The services of Apple, Google, WHOOP and Oura are governed by their own terms.

10. Acceptable use

  • Use Baku for yourself and, in partner mode, for someone who invited you.
  • Do not try to access other people's data, interfere with the service, overload it, or reverse engineer it beyond what the law allows.
  • Do not use Baku to harass anyone, or to upload content that is illegal or infringes someone else's rights, including in gift messages and partner notes.

11. Our content and brand

The app, its design, the Baku name and the Two Rings logo, the scenes, audio, programmes and Atlas texts belong to us or our licensors. You may use them for your personal use of Baku. Sources we cite remain the property of their authors. Press material may be used for reporting about Baku.

12. Availability and changes

We work to keep Baku available and safe, but cannot guarantee that it will always be free of interruptions or errors. Nightlight and other core night features are designed to work offline. We may develop, change or end features; if we end a paid feature, we tell you in good time and refund any part of a period paid to us that you can no longer use.

13. Changes to these terms

We may change these terms for good reasons, such as new features, legal requirements or security. We tell you about material changes at least 30 days before they apply, in the app or by email. If you do not agree you can stop using Baku and cancel your subscription before the change takes effect.

14. Responsibility

We are liable without limitation for intent and gross negligence, and for personal injury where the law does not allow a limitation. Otherwise, to the extent the law permits, we are not liable for slight negligence or for indirect or consequential damage, such as lost profit. This does not restrict your mandatory rights as a consumer. If you live in the EU, the liability rules of your country that cannot be excluded by contract continue to apply.

15. Ending your use

You can stop using Baku and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, after warning you where that is reasonable; you keep the right to export your data.

16. Applicable law and disputes

These terms are governed by Swiss law, without its conflict-of-laws rules and without the UN Convention on Contracts for the International Sale of Goods. The courts at Zug, Switzerland, have jurisdiction, subject to the mandatory places of jurisdiction for consumers: as a consumer you may also sue at your place of residence and can be sued only there. If you live in the EU or the UK, you also keep the protection of the mandatory consumer law of your country. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board, but we are glad to find a solution with you directly: write to support@baku.care.
